The gripping Holiday in Hell, a true^crime^legal^tragedy courtroom drama chronicles a relentless dread subsequent to a 1999 grave assault on an exotic holiday in Cuba. The near death beating could not be charged anywhere in the world! Cuba was reluctant to lay charges however they promised the Canadian police will arrest the perpetrator upon their return at International Pearson Airport. Instead another kick in the teeth! Canadian police declined to arrest the perpetrator, stating: “The Canadian Criminal Code 6 Section 2 puts in plain words: “A Canadian cannot charge another Canadian for a crime committed against them abroad!” In retrospect, my legal case became a violation of my human rights in the International Human Rights Court. A grave assault in Canada gets a maximum 14 years in prison. Was this crime just to be committed in the law of the Canadian democratic land?
Legal advocacy subjected 14 articles branding my case as ‘complicated’. The Toronto Star, The Globe and Mail, and The Toronto Sun reported: Justice of Peace discovers the perpetrator on a pending parole violation for another violent assault. RCMP involves an investigation, Lloyd Axworthy, The Minister of External Affairs, seeks to have the perpetrator extradited to Cuba, a local Sergeant Detective involves Crown Attorneys to debate whether there could be a charge against the crime committed on the Cuban soil. The outdated law evoked outrage and initiated a Canada-wide petition, aiming before the House of Common an amendment: ‘to enable victims to charge crimes committed by another Canadian against them abroad that extends beyond diplomats, victims of aircraft hijacking, hostage taking, protection of nuclear materials, torture, war crimes, piracy” and to the entire population.’
Holiday in Hell is a perilous emotional and legal journey from blind legal naivety to harsh 20/20 reality, a wake-up call for Canadians traveling abroad, mostly conveying to the government of Canada and International Human Rights Courts to set the wheels in motion to bring justice! My case is dragged through riveting courtroom dramas and becomes a precedent-setting in the Supreme Court of Canada, but again only for a parole violation! I hate to see another Canadian go through what I have. The hard-hitting graphic story depicting a brutal assault, the legal horror, TV broadcasts, public petitions, riveting courtroom drama, makes this international story very commercial and highly marketable for a film production.
